ACTION ALERT

House Bill 1013 – Please help support the APRN Compact

A few updates and asks:

  1. The APRN Compact bill (HB 1013) advanced out of Senate Health today with a UNANIMOUS 7-0 vote.
  2. Thank you to all who testified - everyone did such an excellent job! 
  3. The SDSMA testified in opposition. They have testified against in this bill in every other state in which it has been brought, as well as in the S.D. House last week. Their testimony is an attempt to sow confusion.
    1. The APRN Compact speaks to APRNs practicing independent of supervisory or collaborative relationships. This is consistent with SD law.
    2. Inter-professional collaboration, which the compact does not negate in any way, will continue. South Dakota laws, professional ethics, and standard of care all continue to stand for multistate licensees who practice under the compact in SD.
    3. Compact legislation cannot be amended in any way that will be a material deviation from the provisions of the compact (compacts are contractual in nature- everyone needs to join the same one in order to be in the compact). Amendments that clarify, as Utah had done, provisions of the compact, are allowed. Legal review of all such amendments are completed prior to amending the legislation. Please note that at this time we will not accept any amendments.
    4. Disciplinary processes for multistate licensees are identical as they are today. The SD Board of Nursing is able to take action against multistate licensees’ privilege to practice in the state using their enforcement powers. The dispute resolution provisions in the compact (and in all compacts) are a separate matter. They govern disputes between the states in terms of compliance with the provisions of the compact, not for individual licensees themselves.

  1. The bill is expected to be on the Senate floor TOMORROW. Please contact your State Senator. Ask them to vote YES on HB 1013 with NO AMENDMENTS.
